Street and Terrace Openings

PERMITS ARE NOW REQUIRED!

On March 14, 2005, the Campbellsport Village Board of Trustees adopted Ordinance 286 establishing requirements for street and terrace openings.  This ordinance has been duly published and is now in effect. 

 

"No person shall make or cause to be made any excavation or opening in any street, alley, highway, sidewalk or other public way within the village without first having obtained a permit from the Village."

Besides creating the requirement for a permit, the ordinance provides some basic guidelines to follow when excavating within the street right-of-way on public property.

Note:  On May 9th, 2005  the Campbellsport Village Board of Trustees adopted Ordinance 287 amending Ordinance 286.  The primary purpose of this amendment was to transfer responsibility for issuing a 'Street and Terrace Opening Permit' from the building inspector to the Village.

On September 27, 2005. the Campbellsport Village Board of Trustees adopted Ordinance 291 amending Ordinance 286.  This amendament established that there is a requirement to obtain a 'Street and Terrace Opening Permit' prior to making a curb cut, but that there shall be no charge if the permit is, "...obtained solely for removing the street curb for a future driveway opening."  If the permit is required for any other purpose, the regular fee shall apply.  (Currently the fee for a 'Street and Terrace Opening Permit' is $25.)  This amendament was adopted specifically to accomodate new home builders.  When a new house is built, a Driveway Permit will typically be required at some point, but usually not until late in the construction process.   The 'Street and Terrace Opening Permit' allows removal of the back of curb to gain access to a lot for new home construction without first obtaining the Driveway Permit.  The Driveway Permit will still be required prior to actual driveway construction.
